‘Ski the East’ sent a cease and desist order to ‘Snowboard the East’ for trademark infringement

Ski Easta Facebook group with over 40,000 members and an online store selling “Ski the East” products, sent Snowboarding the East a Facebook group with over 15,000 members and an online store selling “Snowboard the East” products, a cease and desist order for trademark infringement.

In a Facebook post last week, Snowboard the East made the announcement while conceding that it would have to change its name. A banner at the top of its website reads “Snowboard The East has no affiliation with Ski The East!”.

Bad news is coming to our team.

It is with great sadness that I post this, but we are under attack from the mighty ski of the east. At this point, I don’t know what to do with the situation other than to change our name. 😢 If anyone has any comments they’d like to share about the situation, feel free to chime in (good vibes only). On the other hand, let’s brainstorm and come up with a new name that we can all agree on and pursue the greatness we all shared together!

Comments on the Facebook post are largely in favor of Snowboard the East and anti Ski the East, with the predictable argument of skiers versus snowboarders. However, many comments about it Facebook post are in favor of Ski the East.

What do you think about it? Is Ski the East within its rights to protect its brand, or is Snowboard the East different enough to be its own brand?
